Colorado’s Labor Department Provides Guidance on Overlap Between HFWA and FAMLI

Most Colorado employees will have two paid leave options as of January 1, 2024. As a reminder, the Healthy Families and Workplaces Act (HFWA) has been in effect since 2020 and provides one hour of paid leave to employees for every 30 hours worked; learn more in Employers Council’s HFWA whitepaper. The Family and Medical Leave Insurance Program (FAMLI) will be available as of January 1, 2024, for employees to take paid leave time; see our FAMLI resources to learn more. 

To assist employers with coordinating these benefits, the Colorado Department of Labor and Employment (CDLE) recently issued a revised Interpretive Notice & Formal Opinion (INFO) #6C. It addresses the overlap between the HFWA and FAMLI and provides a helpful overview of each law and case scenarios to illustrate the various ways these benefits interact.
