Colorado’s Family and Medical Leave Insurance Program (FAMLI) and Healthy Families and Workplaces Act (HFWA) will start to intertwine in 2023. The following are some important dates that will impact your HR calendar from late 2022 to early 2024.
2022
December 2022 – Notify employees that they will have a new deduction from their pay for the FAMLI program. Notice is required by January 1, 2023, and advance notice of a deduction is best practice.
December 27, 2022 – Post notice of FAMLI leave deductions at work sites (required by January 1, 2023).
2023
January 1, 2023 – Employer and employee pay deductions begin for FAMLI.
February 7, 2023 – Employers learn if the 80 hours of public health emergency (PHE) leave under the HFWA is extended beyond February 8, 2023. Employees have had PHE leave available to them since January 2021 for a variety of COVID-19-related needs, as explained in a recent Employers Council article.
September 8, 2023 – This is the date of the complete 48-hour accrual of HFWA sick leave for full-time employees, with no carryover from 2022, who began accruing one hour of sick leave for every 30 hours of work on January 1, 2023.
December 2, 2023 – Employees can start applying for time off as allowed under FAMLI for qualifying leave to commence on January 1, 2024. (If the leave is foreseeable, the employee must provide 30 days’ notice to the employer.)
2024
January 1, 2024 – FAMLI leave available to employees.
January 31, 2024 – If leave is needed for an unexpected illness, employees must apply for time off for unforeseen leave within 30 days after the need arose (if an employee had to take unexpected time off for a medical reason on January 1, 2024).
