California Pay Data Reporting Portal Opens; Reports Due May 8, 2024

On February 1, 2024, the California Civil Rights Department (CRD) opened its online portal for employers to submit their 2023 pay data report. Private employers with 100 or more employees and/or 100 or more workers hired through labor contractors are required to annually report pay, demographic, and other workforce data to the CRD.  

The CRD updated some of its resources since last year, including providing new versions of the templates for inputting and submitting data. The new templates add a column specifically asking for the number of remote employees located within California and the number of remote employees located outside of California. The CRD clarifies that a remote worker is a payroll or labor contractor employee who is entirely remote, teleworking, or home-based, and has no expectation to regularly report in person to a physical establishment to perform work duties; employees in hybrid roles or (partial) teleworking arrangements expected to appear in person to perform work at a particular establishment for any portion of time during the Snapshot Period would not be considered remote workers for pay data reporting purposes.”  

Also new this year is the removal of the option to choose “unknown” when reporting race/ethnicity or sex of a labor contractor employee 

Covered employers should begin preparing their reports in anticipation of the May 8, 2024, deadline to submit to the CRD.
