All Colorado employers of any size and type, whether private sector, public sector, or nonprofit, must take action to comply with the Family and Medical Leave Insurance (FAMLI) program. April 30, 2023, is the deadline for registration and the first premium payments employers must make to FAMLI. In addition, employers must submit wage data. The Colorado Department of Labor and Employment (CDLE) has a library of how-to videos posted here.
Private employers that intend to substitute their own private plan are, for now, not exempt from paying premiums. According to the CDLE website: “All employers must register with the (FAMLI) Division and will be required to pay premiums until they receive approval from the Division. Employers will be able to request a refund for premiums paid in 2023, if their private plan has an effective date on or before January 1, 2024, and they submit an application for private plan approval on or before October 31, 2023.”
Local government employers had until March 31, 2023, to vote out of participation in FAMLI and avoid any payments. Local government employers still may conduct elections to opt out between April 1 and June 30, 2023; however, they will be required to pay premiums and submit wage data for the first quarter of the year.
