California Workplace Safety Update: 2024 Civil Penalty Increases Announced

By Jaimie Graczyk posted 02-29-2024 03:00 PM

On February 22, 2024, Cal/OSHA announced its 2024 civil penalty increases for certain workplace safety violations. The 3.24% increase from last year is based on the Bureau of Labor Statistics’ report on the October Consumer Price Index for All Urban Consumers (CPI-U)

For citations issued on or after January 1, 2024:

  • The maximum penalty for general and regulatory violations, including posting and recordkeeping violations, is $15,873.

  • The maximum penalty for willful and repeat violations is $158,727.

  • The minimum penalty for willful violations is $11,337.

“Serious” violations are the only maximum penalty classification that did not change, which remain at $25,000. Given the potential for a six-figure civil penalty for multiple violations, California employers should ensure their workplace safety plans are up-to-date and their employees are properly trained.
