EEO-1 and EEO-4 Reports Due in December

On October 31, 2023, the U.S. Equal Employment Opportunity Commission (EEOC) opened its portal for the 2022 EEO-1 Component 1 data collection. Employers must file this report to the EEOC by December 5, 2023. It is mandatory for the following employers: 

  • All private sector employers with 100 or more employees. 

  • Federal contractors with 50 or more employees who are prime contractors or first-tier subcontractors and have contracts of $50,000 or more. (Certain federal contracts are exempt from this requirement, and those are listed in regulation 41 C.F.R. 60-1.5.)  

The report includes workforce demographic data by job category, gender, and race or ethnicity. Employers can visit the EEO-1 Component 1 website at www.eeocdata.org/eeo1. There is also an instruction booklet published by the EEOC. 

The 2023 EEO-4 state and local government data collection is open, and reports are also due by December 5, 2023. The EEO-4 is for all state and local governments with 100 or more employees to submit demographic workforce data, including data by race or ethnicity, sex, job category, and salary band every two years. For more information, please visit the EEO-4 website at www.eeocdata.org/eeo4/. School districts have their own EEO-5 report, and this is tentatively scheduled to open in calendar year 2024.
