New Colorado Compliance Requirements Take Effect on August 7, 2023

Colorado employers are subject to new employment laws as of August 7, 2023. This Employers Council article explains the new laws to help you determine if they apply to your organization. Where appropriate, we have published revised guidance to comply with the requirements of some of these laws. Use the links below to access resources that may help. 

All Employers 

  • Protecting Opportunities and Workers’ Rights (POWR) Act: For overall guidance, access this whitepaper (page 6). For new recordkeeping requirements, see this whitepaper (page 10) and the Federal Record Retention Guide (page 73). 

  • Healthy Families and Workplaces Act (HFWA): See page 1 of this whitepaper for an updated list of the qualifying reasons for taking leave. 

  • HB23-1006: Employers must notify employees about the availability of income tax credits. The sample notice will be drafted by the Colorado Department of Revenue and had not been published as of this article’s writing. Employers Council will alert members when the sample notice is published.
