COVID-19 National Emergency Ends; Public Health Emergency Still on Track to Expire in May

By now, you have likely heard that President Biden signed Resolution H.J. Res. 7 on April 10, 2023, which ended the COVID-19 national emergency. The resolution reverses the Trump Administration’s 2020 national emergency, and the move largely impacts the Health and Human Services programs of Medicare and Medicaid. The national emergency is not the same as the federal public health emergency (PHE) declared by the HHS. The federal PHE is still set to expire on May 11, 2023 

In Colorado, employers should expect both the national and state public health emergencies to end on May 11, 2023. That means the PHE leave under the Healthy Families and Workplaces Act (HFWA) will end on June 8, 2023. Arizona, New Mexico, Utah, and Wyoming do not require extended leave due to the PHE, and there is no PHE declared in any of those states.
