RSV and Flu No Longer Reasons for PHE Leave in Colorado

On January 8, 2023, Governor Polis issued executive order D 2023 001, which extends the COVID-19 Disaster Recovery Order for Colorado. What makes the extension significant for some is that it has been amended to remove respiratory syncytial virus (RSV), influenza, and other respiratory illnesses from the covered conditions. COVID-19 is the only remaining reason for using public health emergency (PHE) leave.

The executive order is planned to expire in 30 days, as with previous orders. Therefore, PHE leave is expected to be required at least until March 7, 2023, four weeks after the end of the emergency declaration. The original leave allotment, typically 80 hours, remains the same since the leave was enacted in 2020, and no additional PHE leave is required.

PHE leave is required for a local, state, or federal health emergency. Effective January 11, 2023, the U.S Department of Health and Human Services extended the national COVID-19 PHE order. Generally, the orders are extended quarterly, so an update is anticipated in mid-April. Colorado PHE leave will also be required for four weeks following any expiration of this leave.
