As most Colorado employers now know, they will need to pay money to the state starting in 2023 to fund paid leave under the Family and Medical Leave Insurance Program (FAMLI).
On November 30, 2022, in its monthly newsletter, the Colorado Department of Labor and Employment (CDLE) explained that it has successfully registered more than 1,300 organizations during the soft launch of its employer services portal. Businesses across the state will use the portal to manage their FAMLI accounts by registering, submitting wage data, and paying premiums. The My FAMLI+ Employer portal opened to all Colorado employers on December 1, 2022, and can be accessed here. The portal includes links to helpful information, including how to register for the program.
While all employers will need to register, registration can be completed any time before their first premium payments and wage reports are due on April 30, 2023.
The CDLE has two areas of primary concern to prepare for the FAMLI program, as shown on the alerts on its website. The first is the registration process, and the second is the employee posting requirements. Employers are required to notify their employees about the FAMLI program by January 1, 2023. The Required Program Notice, Paycheck Stuffer, and the 2023 Handbook are located in the FAMLI Employer Toolkit.
Be aware that the program has been evolving. The initial breakroom poster issued by the CDLE is not sufficient employee notice. The required posting by January 1, 2023, is the 2023 Program Notice found within the toolkit.
