Until the 2022 legislative session, the Private Employer Verification Act in Utah required private employers with 15 or more employees to be registered with and use e-verify, or another status verification system, to certify the federal legal working status of new hires. A new bill (H.B. 252), passed in 2022 and signed by the Governor on March 24, changes the threshold for these requirements.
As of May 4, 2022, the new threshold is 150 or more employees. The law doesn’t state whether the threshold is 150 or more in Utah or across all locations in the U.S. An employer wanting to be most risk-averse would treat it as 150 or more across all locations.
This change may immediately affect the procedures required to take on new hires for many employers and may simplify hiring processes.
