Ban the Box Now Applies to Federal Contractors

If you are a federal contractor, you no longer can ask about an applicant’s criminal history before giving the applicant a conditional job offer if they will be working on a government contract. This prohibition was in the National Defense Authorization Act for Fiscal 2020, which took effect on December 20, 2021. A proposed rule that may help employers understand the parameters should be released soon.

Many states already have this as law, so many federal contractor employers who hire employees across the country do not see this as a very large hurdle. We have a sample application that complies with this requirement and is available to our members.
