The well-publicized Kronos timekeeping system hack is still reverberating. Large employers across the United States, including Marriott, Frito-Lay, and New Tiger LLC, have been impacted. While these employers may file suits against Kronos for liability because the hack compromised the ability of the timekeeping system to record overtime hours worked and shorted employees’ pay, employees have the right to sue employers directly.

What kind of agreements do you have with those software providers, so that if there is a hack, responsibilities are clear? What kind of support do they offer? Those are all questions to be answered when the agreement is signed, rather than when a hack occurs.
