In November 2021, the City of West Hollywood approved an ordinance creating new minimum wage and leave requirements beginning January 1, 2022, for hotel employers and July 1, 2022, for all other employers. On May 16, 2022, the City Council approved amendments to the ordinance based on feedback from local businesses.
The City Council approved the following amendments:

In the original ordinance, employers were required to pay out employees once every 30 days for any compensated time off accrued over the maximum cap of 192 hours. The amendment to the ordinance removes this payout requirement.

In the original ordinance, the calculation of the number of employees for coverage of the ordinance was based on the average number of employees per quarter during the 2019 calendar year. Under the amendment, coverage will be determined by the number of employees per quarter during the most recent calendar year. For new employers, an initial determination of size will be based upon the actual number of hires at the time of the business’s opening. After the business has opened, the employee count will be determined by the average number of employees per week who worked for compensation in the first 90 days.

Previously, employers could seek one-year waivers for the minimum wage requirements of the ordinance. Under the amendment, it extends the one-year waiver for financial hardship to comply with paid leave portions of the ordinance.
